The petitioners who are arrayed as accused in Crime No. 29 of 2026 for offences under Sections 296(b), 115(2), 351(2) and 49 of BNS, have filed this quash petition.
2. The contention of the petitioners is that, owing to a dispute between the neighbours regarding a tree and the disturbance allegedly caused by insects from the said tree, there arose a quarrel and exchange of blows. It is a case and counter case. On the complaint given by the petitioners, a case in Crime No.28 of 2026 has also been registered. The respondents 2 and 3 have filed a quash petition in Crl.O.P.No.7129 of 2026, in which this Court granted protection to respondents 2 and 3. Hence, the petitioners seek similar protection. The learned Additional Public Prosecutor appearing for the 1st respondent submitted that it is a case and counter case between the petitioners and the defacto complainants.
3. The learned counsel appearing for the defacto complainants is present and admits the same.
4. In view of the above, the 1st respondent police is directed to follow Police Standing Order 566 and conduct investigation in both Crime Nos.28 and 29 of 2026 and to file final reports accordingly.
5. With the above directions, this Criminal Original Petition is disposed of. Consequently, connected miscellaneous petition is closed. 29-04-2026 AT To 1.The Sub Inspector of Police Pachal Police Station, Tiruvannamalai District.
