..Respondent(s) Prayer: This writ petition is filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the Respondents to consider the petitioner's patta Transfer Application bearing Can.No.13331079559819 and Application No. 2024/0103/31/352726 dated 30.09.2024 in respect of Landed Properties in Survey Nos.18/3, 18/4,18/5 in Pullavedampadhi Village, Uthankarai Taluk, Krishnagiri District measuring an extent of 93 cents, 177 Ares and 89 cents in total 2.92 1/2 cents respectively. ORDER

This writ petition has been filed to consider the petitioner's online application dated 30.09.2024.

Learned counsel for the petitioner would submit that the petitioner has made an online application dated 30.09.2024 to transfer the patta on his favour, in respect of Survey Nos.18/3, 18/4,18/5 in Pullavedampadhi Village, Uthankarai Taluk, Krishnagiri District measuring an extent of 93 cents, 177 Ares and 89 cents in total 2.92 1/2 cents. However, the same was not considered, as on date. Hence, this writ petition.

3. Ms.Inthu Karunakaran, learned Government's Counsel takes notice on behalf of the respondents and submitted that unless and until the petitioner establishes his title to the subject property, they are not in a position to transfer the patta in his favour.

4. Heard the learned counsel on either side and perused the materials available on record.

5. As rightly contended by the learned Government's Counsel, the petitioner is not entitled to the transfer of patta unless and until a Civil Court determines the title of the property. If the petitioner's entitlement to the subject

property is established before the Civil Court, then the question of transferring the patta may arise. Therefore, this Court finds that the writ petition is premature at this stage and is not inclined to grant the relief sought by the petitioner.
