ORDER : The Court Made the following order :- The petitioner, who was arrested on 20.06.2021 and remanded to judicial custody for the offences under Section 306 of IPC, in Crime No.460 of 2021 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the defacto complainant lodged a complaint stating that his daughter was studying in a college on 11.06.2021, she was continuously vomiting. When the defacto complainant enquired about the same, he came to know that his daughter and one Kesavakumar who is studying in a nearby college were loved each other. At that time he had taken some photographs. Later, he started to demand money from her by threatening her as if she die not give money, he will upload the photos in social media. Hence, she consumed poison and committed suicide. Hence, the complaint.
3. The learned counsel for the petitioner submitted that the petitioner is the mother of A1 and she no way connected with the alleged offence and she has been falsely implicated in this case and the petitioner has been in jail from 20.06.2021. Therefore, he prays to grant bail to the petitioner.
4. The learned Government Advocate (Crl.Side) appearing for the respondent submitted that on instigation of A2, A1 demanded money https://hcservices.ecourts.gov.in/hcservices/
from the victim girl and committed theft of two sovereigns of gold ring and received a cash of Rs.25,000/- from her. Due to the threatening, the victim lost her life by committing suicide. Hence, he vehemently opposed for grant of bail to the petitioner.
5. Considering the facts and circumstances of the case and also the fact that earlier application was dismissed by this Court and there is no change of circumstances. this Court is not inclined to grant bail to the petitioner.
