ORDER
This Writ Petition has been filed seeking a direction to the first respondent to transfer the investigation in Crime No.29 of 2025 from the file of the third respondent to the second respondent and to complete the investigation within a time frame to be stipulated by this Court.
2. The case of the petitioner is that the petitioner's son died under suspicious / unknown circumstances. Therefore, the petitioner lodged a complaint, which came to be registered in Crime No.29 of 2025 on the file of the third respondent under Section 194 of the BNSS. It is the grievance of the petitioner that the investigation is still pending. On a perusal of the post-mortem report, nothing has been revealed regarding the exact cause of death.
3. The learned Government Advocate (Criminal Side) appearing for the respondents submitted that the investigation in Crime No.29 of 2025 is in progress. At this stage, the question of transfer of investigation does not arise. It was further submitted that if the investigation is transferred from the file of the third respondent to any other investigating agency, the investigation already carried out by the third respondent would go in vain. Apart from that, no circumstances warranting transfer of investigation have been made out by the
petitioner. Hence, there are no valid reasons to transfer the investigation in Crime No.29 of 2025 from the file of the third respondent to that of the second respondent.
4. In view of the above, the writ petition (criminal) stands dismissed. However, the third respondent is directed to complete the investigation and file a final report in Crime No.29 of 2025 within a period of twelve (12) weeks from the date of receipt of a copy of this order.
