O R D E R

This Writ Petition is filed seeking for a direction to the 3rd respondent to consider the representation of the petitioner dated 08.03.2021 within time frame.

2.The petitioner and his family members are the absolute owners in respect of various extent of house site plots. One Natarajan, who had purchased the Plot No.1 had obtained planning permission showing the southern side as 30 feet road, western side as 16 feet wide road and put up construction in the said plot and is residing there. According to the petitioner, in order to deprive the right of access, he had raised a compound wall by grabbing the petitioner's properties. The vendor of the 4th respondent had obtained a fraudulent patta as if he is the owner of 25 cents of land instead of 18.5 cents and had also obtained planning permission, in which also, the eastern side boundary of the property

purchased by the petitioner and others is shown as 20 feet road. The 4th respondent cheated the authorities by way of producing fabricating and fraudulent documents. Hence, the petitioner had given a representation dated 08.03.2021 to the 3rd respondent to cancel the patta issued in favour of the 4th respondent. Despite the same, the 3rd respondent had not conducted enquiry. Hence, the petitioner has come out with the present Writ Petition. 3.Learned counsel for the petitioner would fairly submit that in the present case, subsequent to the petitioner's representation, he received a notice with regard to filing of the suit by the 4th respondent, claiming title. Therefore, he would submit that all the issues are to be dealt with by the competent Civil Court.

4.Learned counsel appearing for the 4th respondent also submits that a Civil Suit in O.S.No.429 of 2022 has been filed by the 4th respondent claiming title and the same is pending before the District Court at Chengalpattu. He also accepts that the 4th respondent is ready to resolve the issue before the Civil Court.

GSA 5.Upon perusal of the records and the submissions made by both side, it is seen that as the Civil Suit is pending, both the parties are directed to approach the Civil Court to establish their right. With the above direction, the Writ Petition is disposed of. No costs.
