Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus calling for the records pertaining to the impugned order of the respondent passed in R.C.No.7947/B2/2012 dated 13.03.2013 and quash the same and further direct the respondent to accept the inter caste marriage certificate of the petitioner and consequently appoint the petitioner to the post of Graduate Assistant, Maths.

O R D E R

The relief sought for in this writ petition is to call for the records pertaining to the impugned order of the respondent passed in R.C.No.7947/B2/2012 dated 13.03.2013 and quash the same and further direct the respondent to accept the inter caste marriage certificate of the petitioner and consequently appoint the petitioner to the post of Graduate Assistant ( Maths ).

2. The learned counsel appearing for the petitioner states that the case of the writ petitioner has not been considered on account of the fact that he has not produced the Inter Caste Marriage Certificate in an appropriate format. https://hcservices.ecourts.gov.in/hcservices/

3. Now, the learned counsel appearing for the petitioner states that subsequently, the petitioner has produced the Inter caste marriage certificate in an appropriate format. Thus, the case of the writ petitioner is to be considered on merits and in accordance with law.

4. In view of the submissions made by the learned counsel for the petitioner, this Court is inclined to direct the respondents to consider the case of the writ petitioner on merits and in accordance with law and take a decision within a period of 12 weeks from the date of receipt of a copy of this order. The writ petitioner is directed to submit a fresh representation along with a copy of the intercaste marriage certificate, once again to the respondents, enabling them to consider the same.

5. The writ petition stands disposed of with the above observations. No costs. Consequently connected miscellaneous petition is closed.
