ORDER

This criminal original petition has been filed to direct the Learned Metropolitan Magistrate - Fast Track Court No.V, Saidapet to number the case in STC SR.No.4424 of 2025 filed on 04.03.2025.

2.The petitioner, as complainant, filed a complaint under Section 138 of NI Act on 03.03.2025 and the same was registered in STC SR.No.4424 of 2025. It is almost one year and two moths and still the complaint yet to be numbered, hence, filed this petition.

3.Considering that it is a Special Court specifically constituted to try 138 Cases keeping the complaint pending without taking it on file for more than 1 year and 2 months is not proper, whatever may be the reason. Unless the complaint suffers from any defect or deficiency, it cannot be kept pending for any other reason.

4.In view of the above, the Magistrate is directed to take the complaint on file within a period of 10 days from the date of receipt of a copy of this order.
