Writ petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents to consider the representation of the petitioner dated 27.07.2017 and consequently, direct the respondents to prepare a Seniority List in the post of B.T. Assistant for promotion to the post of Higher School Headmaster as mandated by the Service Rules and the Government Orders.

The Writ Petition has been filed seeking to issue a Writ of Mandamus, directing the respondents to consider the representation of the petitioner dated 27.07.2017 and consequently, direct the respondents to prepare a Seniority List in the post of B.T. Assistant for promotion to the post of Higher School Headmaster as mandated by the Service Rules and the Government Orders.

The case of the petitioner is that the petitioner being appointed as a B.T. Assistant (Mathematics) through the Teachers Recruitment Board, joined service w.e.f. 10.07.2004 and her services were regularised from 01.06.2006 onwards. The further case of the petitioner is that though the post of B.T. Assistant is the feeder category to the post of High School Headmaster as per the relevant rules, the respondents have not prepared any Seniority List in the post of B.T. Assistant which has not been published till date. In this regard, the petitioner has given a representation dated 27.07.2017 to the 2nd respondent requesting to prepare Seniority List for B.T. Assistants. But the same has not been done.

Learned Counsel appearing for the petitioner submitted that a direction may be issued by this Court to prepare a Seniority List for B.T. Assistants within a time stipulated by this Court by considering the representation of the petitioner.

Mr.P.Sanjay Gandhi, learned Additional Government Pleader, who takes notice for the respondents 1 to 3 sought 3 months time to prepare the Seniority List for B.T. Assistants by considering the representation of the petitioner.

Considering the facts and circumstances of the matter, the 2nd respondent is hereby directed to prepare a Seniority List of all the B.T. Assistants as per the relevant rules by considering the representation of the petitioner dated 27.07.2017, within a period of three months from the date of receipt of a copy of this Order. 6.
