ORDER
This Writ Petition is filed praying for issuance of a Writ of Certiorarified Mandamus, (a) to call for the records relating to the impugned order dated 17.02.2026 passed by the 2nd respondent and quash the same, (b) consequently direct the 1st and 2nd respondents to grant pension on higher wages to the petitioner under the Employees' Pension Scheme, 1995 based on the Joint Option exercised by the petitioner and the records already available on file including (i) the UAN database records maintained by EPFO, (ii) the Scheme certificate dated 26.04.2024 issued by EPFO, (iii) the Employer-certified wage and pension contribution statements, (iv) the Joint Option Forms submitted pursuant to the Supreme Court judgement, (v) the PF transfer records between
establishments and (vi) the EPFO communication dated 10.01.2003 evidencing membership, contribution history and transfer of accumulations.
2. Learned counsel for the petitioner submitted that though the documents pertaining to 2009, were produced for the purpose of enhanced pension, however, the same was not considered.
3.Learned counsel for the respondents 1 and 2 submitted that the relevant documents pertaining to 17.08.2002 to 31.03.2009 were not furnished, for which reason, the amount was not paid. Since the petitioner is in a position to produce the documents including PF documents, the petitioner undertakes to produce the same before the concerned authority within two weeks. In the event of filing of the relevant documents pertaining to the year 2002 to 2009, the pension as sought by the petitioner, shall be considered. 4.With the above observations/direction, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, the miscellaneous petition is closed.
