..Respondents Writ Petition filed under Article 226 of the Constitution of India praying to issue a writ of mandamus directing the first respondent to return the Ashok Leyland Lorry bearing Registration TN - 32 - C- 8206 seized on 04.04.2022 in the back side of Margabandeeshwarar Temple, Virunchipuram, Vellore District by the second respondent herein to the petitioner herein. ORDER

This writ petition has been filed for a mandamus seeking for a direction to the first respondent to return the seized lorry, which was seized on 04.04.2022, under the provisions of the Essential Commodities Act, 1955.

Learned Special Government Pleader appearing for the respondents, on instructions, would submit that with regard to the return of seized lorry, inquiry is fixed on 08.07.2022. According to him, after holding the inquiry, the fine amount for return of the seized lorry back to the petitioner will be determined.

Learned counsel appearing for the petitioner is willing to participate in the inquiry scheduled to take place on 08.07.2022.

After recording the rival submissions, this writ petition is disposed of by directing the petitioner to participate in the inquiry proceedings conducted by the first respondent with regard to the return of seized lorry back to the petitioner and

determine the fine amount and after holding the inquiry by affording fair hearing to the writ petitioner, the first respondent shall pass final orders within a period of two weeks from 08.07.2022. No costs.
