Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, seeking for a writ of mandamus directing the 1st respondent to consider the petitioner's representation dated 31.08.2015 and to redirect the 3rd respondent herein to give arrear salary from 03.07.2012 and to reallot the work as Over Head Tank Operator.

By consent, the writ petition is taken up for final disposal.

The petitioner was appointed as per the Resolution No.98, dated 09.01.2008 by the Kolathur Panchayat Union as Overhead Tank Operator on a consolidated pay of Rs.600/- per month and would claim, even prior to the appointment, he had temporarily worked in that capacity for 3 years. The petitioner would further state that his Service Register was also opened in the Panchayat Union office and since has pointed out certain irregularities and illegalities on the part of the 3rd respondent, the 3rd respondent has stopped his pay form 03.07.2012 and also taking steps to https://hcservices.ecourts.gov.in/hcservices/

replace him with some other person and in this regard, he has submitted a representation dated 23.04.2013 followed by another representation dated 31.08.2015 and since no orders have been passed and hence, the petitioner came forward to file this writ petition.

Heard the submissions of the learned counsel for the petitioner and Mr.V.Subbiah, learned Special Government Pleader who accepts notice on behalf of the respondents. Though the petitioner has sought for a larger relief, this Court, in the light of the above facts and circumstances, directs the respondents 2 and 3 to consider and dispose of the petitioner's representation dated 31.08.2015 on merits and in accordance with law after putting on notice the 3rd respondent herein and pass orders within a period of eight weeks from the date of receipt of a copy of this order and communicate the decision taken to the petitioner as well as the 3rd respondent. The writ petition is disposed of accordingly. No costs.
