ORDER

This Criminal Original Petition has been filed, under Section 482 of the Code of Criminal Procedure, 1973, praying to direct the first respondent herein, the Commissioner of Police, Chennai to direct the C.C.B. Land Grabbing Cell, Chennai, to register a case based on the complaint given by the petitioner herein, dated 20.01.2014.

2. Heard both sides.

3. It is averred in the petition that the petitioner lodged a complaint before the respondents about the grabbing of his property worth Rs.9 crores for non-payment of a meagre amount and also regarding life threat to him and to his family members, but the police has not registered the case and therefore, the present Original Petition has been filed. https://hcservices.ecourts.gov.in/hcservices/

4. Learned Government Advocate submits that due to non-appearance of the petitioner for the enquiry, on the complaint, which was treated as petition was closed for non co-operation.

5. Learned counsel appearing for the petitioner submits that the petitioner, being aged 75 years is residing in the same address given in the complaint and he is now residing with her daughter in Hyderabad and he is ready to cooperate with the police for the enquiry.

6. Under the above circumstances, the first respondent is directed to peruse the complaint of the petitioner, dated 20.01.2014 and if any cognizable offence is made out, further directed the C.C.B Land Grabbing Cell, Chennai, to register the case and proceed, as per law.

7. With the above direction, this Criminal Original Petition is allowed.
