Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the second respondent to issue patta for old survey no.32/2 natham survey no.106/10 Vanchuvancheri Village Kunnathur Taluk, Kanchipuram District, for the extent of 4800 sq.ft based on the registered sale deed dated 07.11.1985 bearing Document no.5596 of 1985 registered on the file of Sub Registrar Sriperumbudur by considering the representation dated 21.03.2024.

ORDER

With the consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

This Writ Petition is filed to direct the second respondent to issue patta for old survey no.32/2 natham survey no.106/10 Vanchuvancheri Village Kunnathur Taluk, Kanchipuram District, for the extent of 4800 sq.ft based on the registered sale deed dated 07.11.1985 bearing Document no.5596 of 1985 registered on the file of Sub Registrar Sriperumbudur by considering the representation of the petitioner dated 21.03.2024.

3. Heard learned counsel for the petitioner and the learned Government Advocate appearing for the first and second respondents and perused the materials available on record.

The case of the writ petitioner is that originally the subject property has been purchased by one Murugandai Muthaliar from one Jeyaram Naidu in the year 1967, who in turn sold the property to one Chandran and from the said Chandran, the father of the petitioner has purchased the property in the year 1985. Ever since the date of purchase, they are in possession of the 2/5

property. The grievance of the petitioner is that though the he has given a representation to the second respondent for issuance of patta in his name, the same has not been considered by the second respondent till date. Hence the present Writ Petition.

5. The learned Government Advocate appearing for the first and second respondents would submit that since there are objections from the villagers stating that the property is a temple property, they will make enquiry in this regard and pass Orders on merits.

6. Considering the submissions on either side, the second respondent is directed to consider the representation of the petitioner dated 21.03.2024 and conduct enquiry and pass Orders on the same within a period of two months from the date or receipt of a copy of this Order.

7. With the above directions, this Writ Petition is disposed of. No costs.
