ORDER

The petitioner, who was arrested and remanded to judicial custody on 12.03.2026 for the alleged offences under Sections 309(4) of B.N.S. in Cr. No.99 of 2026 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 11.03.2026 at about 7 p.m., the petitioner along with other accused extorted Rs.28 lakhs from the defacto complainant, who is running a Pawn Broker shop and also attempted to attack him. Hence, this case.

3. The learned counsel appearing for the petitioner would submit that the petitioner has been remanded to judicial custody on 12.03.2026 and he is an innocent. The learned counsel would further submit that the petitioner has not at all involved in the occurrence as alleged by the prosecution and hence prayed to enlarge him on bail.

4. However, the learned Government Advocate (Criminal side) appearing for the respondent police would submit that there are four accused and the petitioner is A1. He would further submit that the accused, under a knife point, robbed a sum of Rs.28 lakhs from the defacto complainant and investigation is still pending and hence prays to dismiss the petition.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. Considering the totality of circumstances and upon the fact that investigation is not yet completed, this Court is of the firm view that it is not an appropriate stage to consider the bail application.

7. Accordingly, this Criminal Original Petition is dismissed. 21-04-2026 MJS Note:
