Writ Petition filed under Article 226 of the Constitution of India, seeking for a writ of mandamus directing the respondent to pass orders on the representation dated 14.07.2015 seeking disbursement of accrued and eligible service benefits which fallen due as per law within a time to be stipulated by this Court. By consent, the writ petition is taken up for final disposal.
The petitioners claim that they are the employees of the Hindustan Photo Films Manufacturing Company Limited, Indu Nagar, Ooty and would state that admittedly, the said Unit became defunct and so many revival proposals initiated to refloat the factory, has ended in vain and therefore, left with no other option, the petitioners have submitted applications going on voluntary retirement in pursuant to the Circular issued by the respondent dated 25.02.2015 and though their request for going on voluntary retirement has been accepted and orders have been passed, the other consequential benefits have not been conferred on the petitioners. In this regard, they submitted a representation dated 14.07.2015 to the respondent and since no orders have been passed, they came forward to file this writ petition. Heard the learned counsel for the petitioner and Mrs.Rita Chandrasekaran, learned counsel who accepts notice on behalf of the respondents.
This Court, taking into consideration, the limited scope of prayer sought for by the petitioners and without going into the merits of the same, directs the respondent to consider and dispose of the petitioners' representation dated 14.07.2015 on merits and in accordance with the law and pass orders within a period of eight weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioners.
