T.V.THAMILSELVI,J.

The petitioner, who was arrested and remanded to judicial custody on 09.04.2024 in Crime No.289 of 2024 registered for the alleged offences punishable under Section 174 of Cr.P.C. altered to 302, 201 and 202 IPC r/w 120(b) IPC, seeks bail.

2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He further submitted that based on the confession of the arrested accused A1, he was falsely implicated as if, he was a close friend of the deceased. He further submitted that the petitioner was not present at the scene of occurrence and there is no specific overtact against him. He further submitted that the petitioner was also attributed to conspiracy to kill the deceased. He further submitted that the petitioner is in custody from 09.04.2024 and he is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

3. Learned Government Advocate (Criminal Side) appearing for the respondent police submitted that there are totally three accused in this case and the petitioner is arrayed as A3. He further submitted that based on the confession of the arrested accused, this petitioner was arrested, and he is a close friend of A1. He further submitted that all the accused are present at the scene of occurrence with a drunken mood, committed murder, and the deceased's decomposed photos were also sent to this petitioner and he is the main person. He further submitted that the investigation is not yet completed, therefore, he vehemently opposed to grant bail to the petitioner.

4. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) for the respondent and perused the entire materials available on record.

5. Taking into consideration the facts and circumstances of the case and the submissions made by the learned Government Advocate (Crl.Side) and also considering the gravity of the offence and the fact that

this case needs detailed investigation, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this Criminal Original Petition stands dismissed. 06.06.2024 drl
