Respondents Prayer: Petition under Article 226 of the Constitution of India seeking issuance of a writ of mandamus directing the respondents to initiate speedy and appropriate action to remove the encroachments by way of road formed in S.No.2 and 5 of Odai poramboke namely Karaoni Odai/Echampallam river in No.157, Mukkulanakanahalli Village, Dharmapuri Taluk and District including all encroachments made in Santhakumar River upto South Pennaiyar River (about 42 Kms) so as to enable free water flow in the said river within a limited time frame by this Court. ORDER

(Order of the Court was made by the Hon'ble Chief Justice) This is another matter where the petitioner complains of encroachment.

The petitioner is allowed to make a representation four weeks from date to the District Collector, Dharmapuri district, who will take an appropriate decision in accordance with law upon affording all persons likely to be affected by the order an opportunity of hearing within a period of six weeks thereafter.

2. In the event the writ petitioner is dissatisfied with the decision of the District Collector, the writ petitioner will be entitled to avail of whatever remedies that may be open to the writ petitioner.
