O R D E R

The husband seeks transfer of HMOP No.255 of 2019 on the file of the Family Court at Cuddalore to the Family Court at Villupuram.

2. The transfer is sought for on the ground that the husband is a resident of Villupuram and the proceedings for restitution of conjugal rights in HMOP No.48 of 2020 is pending on the file of the Family Court, Villupuram.

3. It is seen that the proceedings initiated by the wife at Cuddalore are earlier in point of time. The learned counsel for the respondent/wife would submit that it would be very difficult for her to attend the hearing at the Family Court, Villupuram as she would be required to be present for every hearing. It is also seen that the proceedings were initiated by the wife at Cuddalore even in the year 2019.

Considering the same and the convenience of the wife, I am of the opinion that HMOP No.48 of 2020 is withdrawn from the file of the Family Court, Villupuram and transferred to the Family Court, Cuddalore to be tried and disposed of along with HMOP No.255 of 2019 pending on its file. This Transfer Civil Miscellaneous Petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
