Respondent Writ petition filed under Article 226 of the Constitution of India praying for the issuance of a writ of mandamus to direct the respondent herein to consider and pass orders on the petitioner's representation dated 02.02.2016 to include the petitioner's name in the panel of eligible Forest Ranger fit for promotion as Assistant Conservator Forest for the year 2015-2016 in the appropriate place in accordance with the seniority as maintained till date with all consequential service and monetary benefits.

By consent, the writ petition is taken up and disposed of at the admission stage itself.

2. Mr.N.Inbanathan, learned Government Advocate takes notice on behalf of the respondent.

3. The prayer in the writ petition is for the issuance of writ of mandamus to direct the respondent herein to consider and pass orders on the petitioner's representation dated 02.02.2016 by including his name in the panel of eligible Forest Ranger fit for promotion as Assistant Conservator Forest for the year 2015-2016 in the appropriate place in accordance with the seniority as maintained till date with all consequential service and monetary benefits.

4. The case of the petitioner is that he was appointed as a Junior Assistant in the respondent-Department during the year https://hcservices.ecourts.gov.in/hcservices/

1982 and that he was promoted to the post of Forester during the year 1991. The grievance of the petitioner is that though he is eligible for promotion to the post of Assistant Conservator of Forests, his name was not included in the panel prepared for the year 2015-2016. Therefore, he has sent a representation to the respondent dated 02.02.2016. Since, no action has been taken by the respondents till date, he is before this Court.

5. The learned Government Advocate appearing on behalf of the respondent-Department would submit that the respondent has no serious objection for considering the representation of the petitioner, dated 02.02.2016.

6. Taking into consideration of the limited prayer, especially, to consider the representation of the petitioner, this Court without expressing any opinion on the merits of the matter, directs the respondents to consider the representation submitted by the petitioner dated 02.02.2016 and pass appropriate orders on merits and in accordance with law, within a period of four months from the date of receipt of a copy of this order.

7. With the above direction, this Writ Petition is disposed of. No costs.
