O R D E R
The present criminal original petition has been filed to direct the respondent police to register the complainant preferred by the petitioner on 30.10.2015 in CSR.No.921 of 2015 before the respondent police.
2. The petitioner herein has lodged a complaint as against one Vijayakumar stating that on 30.10.2015 at 10.30 p.m., when the petitioner's husband Venkatesan was standing in front of his premises, the said Vijayakumar along with two others came in front of the petitioner's husband and blown the smoke emanating from his cigarette on his face and when he questioned the same, they scolded him and attacked him with wooden log and iron rod and also threatened him. On hearing the petitioner's hue and cry, when the petitioner came out of her house and tried to prevent the said Vijayakumar and two others from attacking her husband, she was also attacked by them and https://hcservices.ecourts.gov.in/hcservices/
further they outraged her modesty. Hence she preferred complaint before the respondent police on 30.10.2015. Though the said complaint has been received and CSR No.921 of 2015 has been assigned, till date no action was taken. Hence, the petitioner has filed the present petition.
3. Learned Additional Public Prosecutor submitted that the complaint has been assigned in C.S.R.No.921 of 2015 and the same is pending for enquiry.
4. From the facts and circumstances of the case, I find that the complaint lodged by the petitioner has been assigned CSR Number as C.S.R.No.912 of 2015. Hence, this Court directs the respondent to conduct an enquiry on the complaint of petitioner dated 30.10.2012 assigned in C.S.R.No.912 of 2015 and upon enquiry, if materials are gathered indicating any cognizable offence, the respondent is directed to proceed further in accordance with law as early as possible. If no prima facie case is made out for investigation, the respondent is directed to pass appropriate order on the complaint.
5. The criminal original petition is disposed of accordingly.
