ORDER

The present criminal original petition has been filed seeking a direction to the learned Judicial Magistrate No.5, Salem, to expedite the trial in C.C.No.81 of 2009 and to dispense with the personal appearance of the petitioners before the trial Court.

2. The petitioners are accused in C.C.No.81 of 2009 on the file of the learned Judicial Magistrate No.5, Salem. In the said case, though the petitioners have been questioned on 10.1.2015 itself, thereafter, there is no progress in the said case. Hence, the petitioners have come up with the present petition seeking a direction to the learned Judicial Magistrate No.5, Salem, to expedite the trial in C.C.No.81 of 2009 and also to dispense with the personal appearance of the petitioners before the trial Court.

3. I have heard the learned Additional Public Prosecutor.

Considering the facts and circumstances of the case and considering the fact that the said case is pending for the past six years, this Court directs the learned Judicial Magistrate No.5, Salem, to expedite the trial in C.C.No.81 of 2009 pending on his file and dispose of the same as expeditiously as possible. The Criminal Original Petition is disposed of accordingly.
