Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India seeking a Writ of Mandamus, directing the 1st respondent herein to consider the representation of the petitioners dated 17.09.2025 and thereby cancel the patta obtained by the 6th respondent for the Panjami and DC lands in Survey Nos.748/1B, 779/2B, 779/2C, 748/2A and 784/2C1 Kuttaiyur Village, Karamadai, Mettupalayam, Coimbatore District and restore the same in Original classification.

ORDER

This Writ Petition is filed to direct the first respondent to cancel the patta standing in the name of the sixth respondent for the property more fully disclosed in the prayer to this Writ Petition, based on the petitioner's representation, dated 17.09.2025 within a time frame to be fixed by this Court.

2. The petitioner claims that being Panjami lands, the sixth 2/6

respondent ought not to have been issued with a patta for the property more fully disclosed in the prayer to this Writ Petition. The petitioner seeks for cancellation of the same through the representation, dated 17.09.2025. The petitioner has filed supporting documents in support of his representation.

3. Mr.R.P.Murugan Raja, learned Government Advocate accepts notice on behalf of the respondent Nos.1 to 5. Since no adverse orders are passed against the sixth respondent in this Writ Petition, notice to the sixth respondent is dispensed with by this Court.

4. No prejudice will be caused to the respondents if the petitioner's representation, as stated supra, is considered on merits and in accordance with law after giving due consideration to the supporting documents produced by the petitioner and after hearing all the necessary parties which includes the sixth respondent in whose name the patta stands for the subject property. This Court is not expressing any opinion on the merits of the petitioner's representation.

5. For the foregoing reasons, this Writ Petition is disposed of by 3/6

directing the second respondent to pass final orders on merits and in accordance with law on the petitioner's representation, dated 17.09.2025 seeking for cancellation of the patta standing in the name of the sixth respondent for the property more fully disclosed in the prayer to this Writ Petition after giving due consideration to the supporting documents produced by the petitioner and after hearing the objections of the sixth respondent and any other third party whom the second respondent deem fit to enquire, within a period of 12 weeks from the date of receipt of a copy of this order. There shall be no order as to costs. W.M.P.no.17680 of 2026 is ordered subject to payment of separate Court fee. Consequently, W.M.P.No.17683 of 2026 is closed.
