O R D E R

This petition has been filed to direct the 2nd respondent herein to register the case on the petitioner's complaint dated 14.06.2016 and consequently direct the 2nd respondent herein to investigate the same in accordance with law.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the State.

3. It is represented by the learned Additional Public Prosecutor that based on the petitioner's complaint dated 14.06.2016, the petition enquiry is pending in CSR No.414 of 2016, before the second respondent and the petitioner is not co-operating in the enquiry.

In view of the above, the petitioner is directed to appear before the second respondent police and co-operate in the enquiry and during the course of enquiry, if any cognizable offence is made out, a regular case shall be registered, in accordance with the law laid down by the Honourable Apex Court in Lalita Kumari vs. Govt. of U.P. & others [(2014) 4 SCC 1], otherwise, the petition may be closed under intimation to the petitioner.

This Criminal Original Petition is disposed of with the above direction.
