ORDER

This writ petition has been filed seeking to issue a Writ of Mandamus, directing the respondent to pass orders on Appeal petition filed by the petitioner against the punishment order dated 05.05.2020 .

2. By consent of counsels for both the parties, this writ petition is disposed of at the admission stage itself.

3. The petitioner was appointed as Electrician in the respondent department on 28.03.1991. A charge memo dated 06.09.2018 was issued against the petitioner and after enquiry, final order was passed on 05.05.2020, imposing punishment of stoppage of three increments. Appeal preferred by the petitioner is pending before the respondent. A panel for promotion for the year 2021 was drawn to the post of Superintendent, wherein, the petitioner's name was not included, citing the punishment of stoppage of increments. Though the petitioner preferred an Appeal before the respondent as early as on 25.06.2020. no final order has been passed. Hence this writ petition.

4. The learned counsel appearing for the respondent submitted that, the Appeal filed by petitioner will be considered and appropriate orders will be passed by the respondent.

5. Inview of the above submission and considering the limited

scope of prayer and to meet the ends of justice, without expressing any opinion on merits, the following order is passed. i) The respondent is directed to dispose the Appeal filed by the petitioner, on its own merits and in accordance with law, as early as possible, within a period of twelve weeks from the date of receipt of a copy of this court.

6. With the above direction, this writ petition is disposed of . No costs.
