ORDER

The criminal original petition has been filed to direct to direct the learned Sessions Judge, Special Court for Trial Cases under SC and ST Act, Thiruvannamalai to accept the surrender application and consider the petitioner's bail application on the same day in connecting with Crime No.61 of 2026 on the file of the Inspector of Police, Chetpet Police Station, 2.Heard the learned counsel appearing for the petitioner as well as the learned Additional Public Prosecutor appearing for the first and second respondents.

3.Upon considering the submissions made and on perusal of the materials available on record, it is seen that the third respondent is maintaining four dogs in his house. On 25.03.2026 at about 8.50 p.m., the dogs belonging to the third

respondent allegedly came out of the house, and the petitioner is alleged to have abused the third respondent by referring to his caste name and also attacked the said dogs. When the third respondent questioned the said act, the petitioner is stated to have immediately assaulted him with a wooden stick on his head. As a result, the third respondent sustained injuries, was admitted to the hospital, and thereafter lodged a complaint. Based on the said complaint, the second respondent police registered a case in Crime No.61 of 2026 for the alleged offences under Sections 294(b), 115(2), 118(1), and 351(3) of the Bharatiya Nyaya Sanhita, 2023, read with Sections 3(1)(r) and 3(1)(s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989. 4.

In view of the above factual position, there shall be a direction to the the Sessions Judge, Special Court for Trial Cases under SC and ST Act, Thiruvannamalai, to consider the petitioner's bail application, preferably on the same day of his surrender, in connection with Crime No.61 of 2026 on the file of the Inspector of Police, Chetpet Police Station, Thiruvannamalai District second respondent Police and to pass appropriate orders in accordance with law, after affording due opportunity to the victim under Section 15-A of the SC/ST (PoA) Act, 1989.
