Respondent Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondent to take action on the petitioner representation dated 28.02.2019 for removing the garbage bin kept in front of the petitioner house to prevent health hazard to the patients coming to the petitioner clinic/hospital, residents of the locality and also to preserve the children's park, drinking water well and water tank.

O R D E R

The petitioner herein is a resident at No.94/C23, 5th Cross Street, Rajaram Nagar, Salem. On 28.02.2019, he gave a representation to the Commissioner, Salem Corporation to remove the dust bin kept opposite to his house leading to littering of garbage causing health hazard. In his representation, he has specifically alleged that the Corporation staff never removed the garbage and solid waste. He is running a Cosmic clinic in his house, in action of the Corporation staff causing health hazard to the public and the patients. The photograph of garbage and solid waste littered all around the street also annexed in the typed set of paper.

2. The learned Standing counsel appearing for the respondent submits that, pursuant to the notice, the Commissioner has personally supervised the ward and has removed the entire https://hcservices.ecourts.gov.in/hcservices/

garbage littered around the street and dust bin has also been removed. The photograph of the clean street has also annexed. It is also further stated that the Corporation has arranged door to door collection of garbage from the residents daily and ensured the street is kept clean.

3. The learned counsel appearing for the petitioner states that the Corporation has taken necessary action and now his street is free from litter.

4. Recording the above submission of the fact, this writ petition is disposed of. No costs.
