ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody on 15.11.2020 for the alleged offences punishable under Sections 302, 120(B) r/w Section 302 of IPC, in Crime No.1307 of 2020, on the file of the respondent police, seeks bail.
2.The case of the prosecution is that the defacto complainant is the brother of the deceased. On 14.11.2020, the petitioner along with other accused persons, assaulted the victim by using knife. Due to which, the victim died in the hospital. Based on the complaint lodged by the defacto complainant, the respondent police registered a case against the petitioner and other accused persons. Hence, the complaint.
3.The learned counsel appearing for the petitioner would submit that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He further submits that the petitioner is in jail from 15.11.2020. Therefore, he prays for grant of bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/
4.The learned Government Advocate (Crl.Side) would submit that the investigation has been completed and charge sheet has filed in PRC.No.4 of 2021 before the learned Judicial Magistrate-I, Coimbatore. He further submit that there are two previous cases pending as against the petitioner. Hence, he vehemently opposed for grant of bail to the petitioner.
5.Considering the fact that there are two previous cases pending against the petitioner, this Court is not inclined to grant bail to the petitioner.
