ORDER
(Order of the Court was made by M.M.SUNDRESH, J.) The petitioner, who is the auction purchaser, pursuant to the sale conducted under the SARFAESI Act, 2002, seeks a direction forbearing the respondents 2 to 5 from demolishing or sealing the building pursuant to the notice issued under Section 57 read with 85 of the Tamil Nadu Town and Country Planning Act, 1971, during the pendency of the Appeal/Revision invoking Section 80-A of the Act.
2.Upon going through the records, it appears that the petitioner has filed an appeal on 10.09.2020 before the first respondent. Action is said to have been initiated pursuant to the complaint made by the erstwhile owner of the property from whom the possession was taken by invoking Section 13(4) of the Act and sale certificate was issued in favour of the petitioner by the Bank being the secured creditor.
3.Considering the above, particularly, the fact that the petitioner's Appeal/Revision invoking Section 80-A of the Act is pending consideration, we direct the respondents to maintain status quo till its disposal. We further direct the first respondent to dispose of the appeal dated 10.09.2020 filed by the petitioner within a period of three months from the date of receipt of a copy of this order.
