These Original Applications are filed for restraining the respondents from using and altering the physical structure of the Schedule A mentioned property for any purpose, commercial or otherwise, pending disposal of the suit.

This Court on 22.05.2024, considering the relief sought in the suit for recovery of possession under Section 6 of the Specific Relief Act, 1963, and the interim relief sought in the applications caused notice to the respondents and granted ad interim injunction. Subsequently, the interim order was extended until further orders. Meanwhile, the respondents has filed counter on merits and also an affidavit stating that without prejudice to the merits of the case, they undertake not to use or lease out the suit property for any commercial purpose and will not carry out any alteration of the physical feature of the building pending disposal of the suit. Further, the respondents/defendants had also made it clear through his affidavit that in the event of any requirement to alter the physical features or to use or let out the suit property on lease, they will approach this Court to obtain appropriate direction.
