ORDER

The writ petition is filed for the below relief: "directing the respondents to pay 10 percent interest towards belated payment of terminal benefits such as Provident Fund, Gratuity, Leave Salary and commutation of pension amount to the petitioners".

2. The brief facts which has culminated in the filing of this writ petition are set out below:

2.1. It is the case of the petitioners that they were retired employees of the first respondent Corporation and retired from service on attaining the age of superannuation. The respondents settled their terminal benefits with a delay. Therefore, the respondents are legally bound to pay interest to the petitioners. Therefore, the petitioners made a representation to the respondents to pay the interest at the rate of 10% p.a., for the belated payment of the petitioners'

Provident Fund, Earned Leave Salary, Gratuity Amount and Pension Commutation Amount. Since there is no response, the petitioners are before this Court.

3. Heard the learned Counsel on either side and perused the materials available on records.

4. Admittedly, the Provident Fund, Earned Leave Salary, Gratuity Amount and Pension Commutation Amount has been paid belatedly for no fault of the petitioners. Therefore, the petitioners are entitled to interest on the same. Therefore, the Writ petition is allowed as prayed for and a mandamus is issued directing the respondents to disburse the 6% interest for belated payment of Provident Fund, Earned Leave Salary, Gratuity Amount and Pension Commutation Amount within a period of one (1) month from the date of receipt of a copy of this order.
