This Writ Petition has been filed to issue a Writ of Mandamus directing the respondents 1 to 3 to take suitable action against the respondents 4 and 5 in a manner known to law, based on the complaint dated 21.03.2023 made to the 2nd respondent and representation dated 18.01.2024 issued to the respondents 1 to 3, within a time-frame as may be fixed by this Court.
2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Criminal Side) appearing for the official respondents and perused the materials available on record.
3. Though there is no urgency in this writ petition being entertained during the summer vacation, this Court is not inclined to dispose the writ petition as part-heard. It appears that there is a family dispute between the petitioner and the fourth respondent who appears to be the petitioner's brother-in-law and the fifth respondent is the relative of petitioner's in-law. Further, it appears that the petitioner's husband has dispute with the fourth respondent and hence, the petitioner is being dragged into the dispute and manhandled.
4. Having regard to the submissions made by the learned counsel on either side and taking into consideration the limited prayer sought for by the petitioner, without expressing any opinion with regard to the merits of the case, this Court is inclined to dispose the writ petition after dispensing the notice to the fourth and fifth respondents, by directing the third respondent duly accompanied by a lady officer to investigate the complaint of the petitioner dated 21.03.2023 made to the second respondent and consider the representation dated 18.01.2024 issued to the respondents 1 to 3, along with any other complaint that has been filed by the petitioner's family, as early as possible.
5. With the abovesaid directions, the Writ Petition is disposed of. There shall be no order as to costs.
