ORDER

This Criminal Original Petition has been filed seeking to set aside and modify the condition imposed in M.P.No. 1 of 2026 in Crl.A.No. 75 of 2026 dt. 24.02.2026 on the file of the Principal District and Sessions Judge at Thiruvallur and enlarge the petitioner on bail.

2. The petitioner is the accused in S.T.C.No.135 of 2024 on the file of Judicial Magistrate, Fast Track Court, Poonamallee. By judgment, dated 06.11.2024, the petitioner was sentenced to undergo one year of simple imprisonment and to pay compensation of Rs.20,00,000/-. The petitioner was subsequently secured and remanded to judicial custody on 15.12.2025 and he was in prison for 71 days. While the petitioner was in prison, he had filed an appeal in CA.No.75 of 2026 along with a petition for suspension of sentence. The learned Sessions Judge while suspending the sentence and granting bail, imposed a condition directing the petitioner to deposit 20% of the compensation amount, i.e., Rs.4,00,000/- within a period of sixty days. The petitioner is unable to pay the said amount. Hence, the present petition.

3. The case projected by the complainant is that he is a software developer and doing business. The complainant had advanced a sum of Rs.17,50,000/- to the petitioner as loan. For the period of 17 months i.e. from 01.03.2021 to 31.07.2022, interest accrued to the tune of Rs.4,46,250/-. Admitted portion is that the petitioner paid a considerable amount as interest for the 17 months period and the petitioner was in prison for 71 days.

4. In view of the above, considering the petitioner's financial position and the arguable points involved in the appeal, this Court is of the view that the

order of the Sessions Court, directing the petitioner to deposit 20% of compensation amount, is not proper. Therefore, taking into account the cheque amount of Rs.17,50,000/- and giving credit to the interest amount of Rs.4,46,250/- already paid by the petitioner, and upon an overall consideration of the facts of the case, this Court is inclined to modify the condition. Accordingly, the condition imposed by the Sessions Court is modified and the petitioner is directed to deposit a sum of Rs.2,50,000/- (Rupees two lakhs and fifty thouand only) to the credit of S.T.C.No.135 of 2024 on the file of Judicial Magistrate, Fast Track Court, Poonamallee within a period of one month from the date of receipt of a copy of this order. Accordingly, this Criminal Original Petition is disposed of. Consequently, connected miscellaneous petition is closed.
