ORDER
This writ petition is filed for the following relief: "To directing the respondent to pay difference in leave salary and difference in gratuity with 10 percent interest as per
14th wage settlement dated 24.08.2022 to the petitioner."
2. Heard the learned counsel appearing on either side and perused the materials available on record.
3. The petitioner joined the service of the respondent corporation as Driver on 21.01.1998 and retired on 30.11.2019 as a Special Grade Conductor. Subsequently, the 14th Wage Settlement was entered into between the Management and the Trade Unions on 24.08.2022, pursuant to which the wages and pension were also revised with effect from 01.09.2019. Since the petitioner had retired on 30.11.2019, he is entitled to the difference in leave salary and gratuity as per the 14th Wage Settlement. Accordingly, the petitioner submitted a representation seeking the difference in leave salary and gratuity as per the 14th wage settlement dated 24.08.2022. However, the said representation has not been considered so far.
4. In view of the above, the respondent is directed to pay the applicable differential amount of leave salary, gratuity to the petitioner, in accordance with the 14th Wage Settlement dated 24.08.2022, together with
interest at the rate of 6% per annum, within a period of twelve weeks from the date of receipt of a copy of this order.
5.With the above direction, this Writ Petition stands allowed. No costs.
