Respondents Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, directing the respondents to disburse 34 months salary to the petitioner for the suspension period from 11.02.2009 to 25.01.2012. ORDER

This writ petition has been filed with a huge delay of more than five years claiming the so called subsistence allowance, which is said to have been not paid for the suspended period from 11.2.2009 to 25.1.2012.

2. Learned counsel for the petitioner submitted that the petitioner reached the age of superannuation long time back viz., on 30.6.2014 and he was also relieved from service on reaching the age of superannuation.

3. When the petitioner was permitted to retire from service on attaining the age of superannuation with effect from 30.6.2014, it is not known how the petitioner can keep quiet from 25.1.2012 in not asking or demanding or claiming the subsistence allowance, if https://hcservices.ecourts.gov.in/hcservices/

not paid from 11.2.2009 to 25.1.2012. When he has failed to claim his subsistence allowance during 2013, 2014, 2015, 2016 or 2017, he cannot come to this Court with a belated prayer. Therefore, this Court in view of long lapse of time, is not inclined to entertain the writ petition. Accordingly, the writ petition is dismissed. No costs.
