ORDER

This petition has been filed seeking to transfer the S.C.No.47 of 2009 from the file of the learned Additional Assistant Sessions Judge Puducherry to a learned Sessions Judge of Competent jurisdiction at Chennai for proper conducting of the trial.

2. When the matter came up on 31.07.2017, there was no representation for the petitioner and hence the matter was directed to be posted on 16.08.2017 under the caption "for dismissal". On 16.08.2017, when the matter was taken up, counsel for the petitioner had appeared and informed the court that she would get instructions from the petitioner whether the case could be transferred to the file of the Additional Sessions Judge, Karaikkal and hence the matter was directed to be posted on 23.08.2017. On 23.08.2017 when the matter was called at 11.00 A.M. and again at 1.20 P.M., there was no representation for the petitioner and hence the matter was directed to be posted on 24.08.2017 under the caption "for dismissal". Thereafter, the matter is listed today under the caption "for dismissal".

3.Even today, when the matter was called, there is no representation for the petitioner. Hence, the Crl.O.P. is dismissed for non-prosecution. Consequently, M.P.No. 1 of 2011 is also dismissed. 29.08.2017 gr.
