2. It is seen that service is complete.
3. This petition is resisted by filing counter affidavit by the learned counsel for the third respondent.
4. We have perused the affidavit filed in support of the petition as well as the counter affidavit.
5. Considering the period of delay being 38 days and the reasons mentioned in the affidavit filed in support of the petition, we are of the view that the delay can be condoned.
6. Accordingly, delay is condoned and this petition is allowed.
