ORDER : The Court Made the following order :- The petitioner seeks bail under Section 439 of Cr.P.C., for the alleged offences under Sections 174 of Cr.P.C., and 306 of IPC.
2. According to the prosecution, the petitioner and deceased loved each other and they got married. It is alleged that the petitioner had a wordy quarrel with the deceased/wife and forced her to take tablets which prompted her to commit suicide by hanging. The defacto complainant is the father-in-law of the petitioner. He alleged that his daughter committed suicide due to the harassment of the petitioner.
3. The learned counsel for the petitioner submitted that the petitioner and the deceased belonged to different communities and they got married against the wishes of their parents. Therefore, the defacto complainant lodged a false complaint against the petitioner.
4. The learned Government Advocate (Crl. Side) submitted that the petitioner was arrested on 26.10.2017. He further submitted that due to wordy quarrel between the petitioner and the deceased/wife, she committed suicide by hanging.
5. Having regard to the nature of the allegations against the petitioner and taking note of the fact that there is no dowry harassment against the petitioner and investigation is also almost
complete, further incarceration of the petitioner may not be necessary for further investigation. Hence, this Court is inclined to grant bail to the petitioner subject to the following conditions.
6. (i) Bail is granted.
(ii) Petitioner is ordered to be released on bail on his executing a bond for Rs.10,000/- each with two sureties each for the likesum to the satisfaction of the learned Judicial Magistrate, Tambaram.
(ii) Petitioner shall report before respondent police daily at 10.30 a.m. for a period of two weeks and thereafter, as and when required for interrogation.
