Writ Petition filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 and 2 to grant Joint Patta in Patta No.360, in respect of the land in S.No.123/7A2 (Old No.123/7) of Nerigam Village, Shoolagiri Taluk, Krishnagiri District, based on the petitioners dated 19.12.2016 and 04.09.2017.

O R D E R

Mr.E.Balamurugan, learned Additional Government Pleader takes notice for the respondents 1 and 2. Since this writ petition is being disposed of, without affecting the interest of the respondents 3 to 6, notice to those respondents is dispensed with.

2. The petitioner seeks for a mandamus directing the respondents 1 and 2 to consider his representations dated 09.12.2016 and 04.09.2017, wherein and whereby, he sought for issuance of Patta in respect of the subject matter land.

3. Heard both sides.

4. The grievance of the petitioner before this Court is that the said representations have not been considered so far. This Court, at this stage, is not expressing any view on the merits of the claim made by the petitioner, as it is for the concerned Revenue Official namely, the Tahsildar, Hosur, Krishnagiri District to consider and decide the same on merits and in accordance with law. However, it is seen that the present representations are given only to the respondents 1 and 2 and not to the concerned Tahsildar. Accordingly, this writ petition is disposed of, as follows:

(a) The respondents 1 and 2 shall forward the representations of the petitioner dated 09.12.2016 and 04.09.2017, to the concerned Tahsildar, within a period of two weeks from the date of receipt of a copy of this order.

(b) On receipt of such representations, the concerned Tahsildar will pass the orders on merits and in accordance with law, within a period of six weeks thereafter, after hearing the petitioner as well as the respondents 3 to 6 and other interested parties, if any. No costs.
