PRAYER in W.P. No. 3436 of 2017 :Writ Petition is filed under Article 226 of Constitution of India praying to issue Writ of Mandamus directing the Respondents 2 and 3 to give adequate police protection for conducting Maha Sivarathri Pooja and Car Festival in Arulmighu Poongavanathamman @ Angalamman Thirukoil in Vilangamudi Village, Pochampalli Taluk, Krishnagiri District from 24.02.2017 till 28.02.2017 by the petitioner, as hereditary trustee, by considering the petitioner's representation dated 02.02.2017.

COMMON ORDER The prayer in these Writ Petitions is to issue Writ of Mandamus directing the Respondents 2 and 3 to give adequate police protection for conducting Maha Sivarathri Pooja and Car Festival in Arulmighu Poongavanathamman @ Angalamman Thirukoil in Vilangamudi Village, Pochampalli Taluk, Krishnagiri District by considering the petitioner's representation dated 01.02.2018.

2. Heard Mr.R.Neelakandan, learned counsel appearing for the petitioner and Mr.M.Maharaja, learned Special Government Pleader appearing for the first respondent and Mrs.R.Krishnapriya, learned Additional Government Pleader appearing for the respondents 2 & 3.

3. In view of the order of the Revenue Divisional Officer dated 09.02.2018, refraining both the parties from conducting the festival, it would not be appropriate to extend police protection to enable the petitioner to conduct the festival.

4. It is submitted by the learned counsel appearing for the petitioner that the proceedings of Revenue Divisional Officer has not been communicated to him. I do not wish to express any of my views with regard to the said communication. If at all the petitioner is aggrieved, it is open to him to challenge the same in a manner known to law. However, it is seen from the the order of the Revenue Divisional Officer that the petitioner has subscribed her signature on behalf of the 'A' Party. In my view, without challenging the order of Revenue Divisional Officer, the present petitions may not be maintainable. Hence, W.P. No. 2951 of 2018 stands dismissed. No Costs.

Since the prayer in W.P.No. 3436 of 2017 is seeking for protection for conducting Maha Sivarathri Pooja from 24.02.2017 to 28.02.2017, the same is dismissed as having become infructous. Consequently, the connected Miscellaneous Petition is closed.
