PRAYER:- This Second Appeal is filed under Section 100 of Code of Civil Procedure, 1908, to set aside the judgement and decree passed by the learned Subordinate Judge, Jayankondam dated 24.02.2021 made in A.S.No.02 of 2020, confirming the judgment and decree dated 04.12.2019 made in O.S.No.245 of 2011 on the file of the District Munsif Court at Jayankondam.

JUDGMENT

When the matter came up on 11.07.2025, none represented the appellant. Whereas, the learned counsel for the respondent would submit that the defendant handed over the possession of the suit property to the plaintiff herein in E.P.No.1 of 2022 on the file of the Principal District Munsif 1/3

Court, Jayankondam and EP was also terminated by an order of the said Court dated 18.04.2023.

2. Recording the said details, as the possession was handed over by the defendant, the appellant who is the defendant has preferred this appeal, this Second Appeal stands dismissed as nothing survives for consideration. There is no order as to costs.
