Prayer: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondent to conduct a Pre-bid meeting afresh and release a new set of Prebid Addendum / Corrigendum I, II, III & IV to RFP in Tender No.RFP No.17/44017/Proj/MTC/2020 for selection of System Integrator to Design, Supply, Implement, Commission, Operate and Manage the Safe City Solution as a part of Nirbhaya Safe City Project for Metropolitan Transport Corporation. ORDER
This Writ Petition has been filed challenging the conduct of the Pre-bid meeting by the respondent with regard to the tender notice dated 27.07.2020 issued by the respondent inviting tenders for providing System Integrator to Design, Supply, Implement, Commission, Operate and Manage the Safe City Solution as part of Nirbhaya Safe City Project for the respondentCorporation. 2.
Mr.Vijay Narayan, learned Advocate General representing the respondent would submit that the Writ Petition has now become infructuous, in view of the fact that the https://hcservices.ecourts.gov.in/hcservices/
contract, pursuant to the tender notice dated 27.07.2020 issued by the respondent, has already been awarded on 03.02.2021 and work order was also issued thereafter on 04.02.2021. Therefore, this Court is of the considered view that if at all, the petitioner is aggrieved, he has to challenge the award of the contract by the respondent. The petitioner has challenged only the conduct of the Pre-bid meeting of the respondent in this Writ Petition. Therefore, the prayer sought for in this Writ Petition has now become infructious, in view of the fact that the contract has already been awarded by the respondent. 3.
Accordingly, the Writ Petition is disposed of. No costs. However, liberty is granted to the petitioner, if so aggrieved to challenge the contract that has been awarded to a party pursuant to the tender notice dated 27.07.2020 issued by the respondent-Corporation in accordance with law.
