The petitioner/Appellant has filed this petition to condone the delay of 444 days in filing the appeal against the award passed by the Motor Accidents Claims Tribunal, IV Additional District Court, Ponneri in MCOP No.629 of 2014, dated 14.03.2019.
2. Heard the learned counsel for the petitioner/appellant.
3. The learned counsel appearing for the second respondent has got no serious objection in allowing the petition.
However, he submitted that in the event of compensation is enhanced, the appellant/claimant is not entitled for any interest for the period taken for filing appeal.
4. Considering the submission and being satisfied with the reasons assigned in the affidavit filed in support of this petition, the delay is condoned and this petition is allowed. In the event of the compensation amount is being enhanced, the appellant is not entitled for interest for the default period.
5. Registry is directed to number the Civil Miscellaneous Appeal, if it is otherwise the papers are found to be in order and post the matter on 09.11.2020 for admission.
