K.GOVINDARAJAN THILAKAVADI, J., The Petitioners, who apprehend arrest at the hands of the respondent police for the offence punishable under Section 399 of IPC in Crime No.255 of 2023 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that while the respondent Police were patrolling near Thirupathikundram to Kundugulam Mud road, they found two white cars parked in that area. Thereafter, on enquiry, it was found that one Sekar and Chandru from Chellaperumpulipedu Village, Kancheepuram along with accused persons had planned for a dacoity on 04.05.2023 and gave two cars and three knives for the said plan. Hence, the said persons were arrested and remanded to judicial custody.

3. The learned counsel for the Petitioners would submit that the Petitioners are innocent persons and a false case has been foisted against them. Therefore, he prayed for grant of anticipatory bail to the Petitioners.

4.The learned Additional Public Prosecutor appearing for the respondent opposed for grant of anticipatory bail to the Petitioners stating that since both the petitioners planned to commit dacoity on 04.05.2023, they were arrested by the respondent Police.

5. Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor appearing for the respondent.

6. Considering the gravity of the offence and also considering the submission made by the learned Additional Public Prosecutor appearing for the respondent, this Court is not inclined to grant anticipatory bail to the petitioners. Accordingly, this Criminal Original Petition is dismissed. 11.05.2023 srn
