O R D E R

The present criminal original petition has been filed seeking a direction to the Respondent to register the complaint dated 19.12.2015 in C.S.R.No.528/2015 on the file of the Inspector of Police, T-2 Ambattur Estate Police Station, Chennai District.

2. In the petition, it has been stated that the petitioner was working in a firm viz Jus' effex Company for a period of ten years as quality analyst. The Chairman and Managing Director of the said firm made the petitioner to carry out the additional task in the firm beyond the normal routine and thereby compelled the petitioner to stay in the office beyond the office hours. When the petitioner opposed the same, she was harassed and threatened with dire consequences and they also obtained a resignation letter from her under duress. Hence she lodged a complaint against the above said persons on 19.12.2015. Though the respondent has received the same, no action has been taken till date. Hence, the present criminal original petition has been filed.

3.Learned Additional Public Prosecutor submitted that the allegation made in the complaint does not constitute cognizable offence. He further submitted that the complaint has been assigned in C.S.R.No.528 of 2015 and matter is still pending enquiry.

4.I have heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

5. Considering the submissions made on either side, this Court directs the respondent to conduct an enquiry on the complaint dated 19.12.2015 given by the petitioner pending in C.S.R.No.528 of 2015 and upon enquiry, if materials are gathered indicating commission of any cognizable offence, the respondent is directed to proceed further in accordance with law, as early as possible. If no primafacie case is made out for registering the complaint, the respondent is directed to pass an appropriate order on the said complaint.

6. This criminal original petition is disposed of accordingly.
