This writ petition has been filed seeking issuance of a writ of mandamus directing the first respondent to issue passport in favour of the petitioner based on the application submitted by the petitioner on 27.12.2024.
2. Heard Mr.G.Ashok Kunar, learned counsel for petitioner, Ms.Sangeeta, learned counsel appearing for first respondent and Mr.Leonard Arul Joseph Selvam, learned Government Advocate [Crl.side] appearing for second respondent.
3. The first respondent has not considered the application submitted by the petitioner on the ground that a First Information Report in Crime No.121 of 2017 is pending on the file of the second respondent.
4. Learned Government Advocate [Crl.side] appearing on behalf of the second respondent submitted that investigation is yet to be completed in this case and the petitioner has been arrayed as an accused (A9) in this case.
5. Mere registration of a First Information Report cannot be a 2/4
ground for the first respondent not to consider the application submitted by the petitioner seeking for issuance of passport.
6. In the light of the above discussion, there shall be a direction to the first respondent to deal with the application submitted by the petitioner and issue passport if the petitioner satisfies all the other requirements. Mere pendency of the First Information Report should not be put against the petitioner.
This writ petition is disposed of with the above direction. No costs.
