ORDER
The petitioner apprehends arrest for the alleged offence under Sections 8(c) r/w. 22(c), 25 and 29(1) of the NDPS Act in Crime No.44 of 2026 on the file of the respondent police seeks anticipatory bail.
2. The case of the prosecution is that petitioner along with co-accused was found in possession of certain narcotic substances of 10 grams of Methamphetamine, No. 50 Tablets MDMA(23.50 grams) and 55 grams of Cocaine and the same were seized by the respondent police. Hence, the case.
3. The learned counsel for the petitioner submitted that the occurrence took place on 16.06.2026 there was a recovery of 10 grams of Methamphetamine. He further submitted that the petitioner is innocent and he has not committed any offence as alleged by the de facto complainant and he has been falsely implicated in this case. He further submitted that he is ready to abide by any conditions that may be imposed by this Court and ready to cooperate with the investigation. Hence, he prayed to grant anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the investigation is still pending. Hence, he opposed to grant anticipatory bail to the petitioner.
5. I have given my anxious consideration to either side submissions and perused the materials available on record.
6. Considering the facts and circumstances of the case, taking note of the submissions made by the learned counsel on both sides, considering the fact that the total recovery involved is a commercial quantity and as rightly contended by the learned Government counsel (Crl.Side), this Court could not find any material to overcome the rigour under section 37 of NDPS Act and apart from that the case is still under investigation. Hence, this Court is not inclined to enlarge the petitioner on bail.
7. Accordingly, this Criminal Original Petition stands dismissed. 23-06-2026 SHL To:
