O R D E R

The instant writ petition has been filed with a prayer for issuing a mandamus to direct the respondents to grant the family pension to the petitioner, since her son died on 14.02.2019 while in service and nominated the petitioner for family pension.

2. The learned counsel for the petitioner would submit that the petitioner's son worked as a Line Man in Namakkal with the TANGEDCO. 2/6

3. It is the further submission of the petitioner that his son got divorced by virtue of order in H.M.O.P.No.154 of 2004 before the Principal Subordinate Judge, Erode. Subsequently, the petitioner's son died on 14.02.2019. There are no other Class 1 legal heir to him except the petitioner and her grand daughter. Therefore, the petitioner alone is entitled to receive the family pension. He further submits that the petitioner's granddaughter, who is the daughter of the deceased son, has also given her no objection in favour of the petitioner to receive the family pension. However, the respondents have not sanctioned the pension so far. In this connection, the petitioner has made a representation dated 22.09.2021 to the respondents. Since the same has not been considered, the present writ petition has been filed.

4. The learned Standing Counsel appearing for the respondents would submit that they would consider the petitioner's representation within a reasonable time.

5. Heard the learned counsel for the petitioner and the learned Standing Counsel appearing for the respondents and perused the materials available on record.

In such view of the matter, without going into the merits of the Writ Petition, this Court deems it appropriate to direct the respondents to consider the petitioner's representation dated 22.09.2021 and pass order on its own merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.

7. With the above directions, this Writ Petition is disposed of. No costs.
