The learned counsel for the petitioner made an endorsement indicating that he is withdrawing the Civil Revision Petition with liberty to the petitioner to agitate all the points before the trial Court.

2. In view of the endorsement so made, the Civil Revision Petition is dismissed as withdrawn. It is open to the petitioner to take up all the defences available to him before the trial Court. No costs. Consequently, connected miscellaneous petition is closed.
