Respondents Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, to direct the first respondent to consider and pass orders on the representation dated 29.06.2017 of the petitioner, for the payment of subsistence allowance for the period of his suspension.

ORDER

The petitioner was appointed as a Noon Meal Organizer during the year 1982 at P.Puthur Panchayat Union School, Paramakudi. On 9.2.88, he was placed under suspension on certain allegations that he had misappropriated the noon meal food items. However, he was reinstated in service with effect from 30.4.2004. But his grievance is that he was not paid with any subsistence allowance during the period of suspension. Although he was waiting during the service period expecting them to settle the subsistence allowance for the said period, the respondents have not taken any action. Therefore, he has given a representation on 29.6.2017 and the same has not been considered. Hence, a direction is sought for.

2. The learned Government Advocate for the respondents sought four weeks time to consider the pending representation of the petitioner.

3. Placing on record his request, the first respondent is hereby directed to consider the representation of the petitioner on https://hcservices.ecourts.gov.in/hcservices/

merits and it is made clear that if the petitioner was not paid with the subsistence allowance during the period of his suspension, the first respondent shall pass appropriate orders including the payment of subsistence allowance, within a period of four weeks from the date of receipt of a copy of this order.
