CR.NO.6 OF 2021.
For Petitioner : M/S.P.K.GANESH Advocate For Respondent : MR. C.E.PRATAP, Govt. Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offence under Sections 419, 465, 468, 471, 420 & 34 of IPC in Crime No.6 of 2021, on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that the defacto complainant has lodged a complaint against the petitioners as the petitioners have created a fake power of attorney and executed the same in favour of A3 for Plot No.44 & 45 comprised in S.No.344/2B measuring an extent of 2940 sq.ft situated at Lakshmi Nagar, Varadharajapuram Village, Sriperumbudur. A11/petitioner is signed as witness in the power of attorney.
3.The learned counsel appearing for the petitioner submits that the petitioner is an innocent person and he has been falsely implicated in this case. He further submits that the petitioner/A11 has signed as witness in General Power of Attorney Document alone. Hence he prays for grant of anticipatory bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/
4.The learned Government Advocate submitted that the property was owned by the defacto complainant and the petitioner and other accused persons impersonated A1 as defaco complainant and created a fake power of attorney in favour of A1 and the same was sold in favour of A4. Hence, he vehemently opposed for grant of anticipatory bail to the petitioner.
5.Considering the gravity of offence and the earlier anticipatory bail petitions were dismissed by this Court and there is no change of circumstances, this Court is not inclined to grant anticipatory bail to the petitioner.
6.Accordingly, this criminal original petition is dismissed. -sd/- 23/09/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.) High Court, Madras - 600 104.
